DMCA Copyright Policy

Three Peaks Realty LLC, operated by Evan Brown and brokered by LPT Realty LLC (“we,” “us,” or “our”), respects the intellectual property rights of others and expects users of our website, evanbrownrealestate.com, to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) (“DMCA”), we have registered a Designated Agent with the United States Copyright Office and will respond promptly to valid takedown notices.

2. How to Submit a Copyright Infringement Notice

If you believe that content on evanbrownrealestate.com infringes your copyright, please send a written notice to our Designated Agent (contact information above) that includes all of the following elements, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work(s) claimed to have been infringed. If multiple works are covered by a single notification, a representative list is sufficient.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to allow us to locate the material on our site (e.g., the full URL of the specific page).
  4. Your contact information — address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Incomplete notices may not receive a response. We recommend sending notices by email to evan@evanbrownrealestate.com with the subject line “DMCA Takedown Notice.”

3. Counter-Notification Procedure

If you believe that material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. A valid counter-notification must include, under 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location where it appeared before removal (e.g., the URL).
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which we may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of that person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant files a court action to restrain the restoration.

4. Repeat Infringer Policy

In accordance with the DMCA and applicable law, we have adopted a policy of terminating, in appropriate circumstances, the accounts or access of users who are repeat infringers of intellectual property rights.

5. Safe Harbor Compliance

We operate this website in compliance with the DMCA safe harbor provisions set forth at 17 U.S.C. § 512. Our Designated Agent is registered with the U.S. Copyright Office. We act expeditiously upon receipt of valid infringement notices and do not financially benefit from infringing activity over which we have the right and ability to control.

Content sourced through licensed feeds is governed by the applicable data license agreements between us and those providers. If you believe MLS listing data or associated photographs infringe your copyright, please include in your notice the specific listing ID or URL and the nature of your ownership claim.
